What is labor law?

Employment law is an area of law that regulates the relationship between employer and employee. The aim is to achieve a balance between the interests of employer and employee.

The basis for the regulations is the employment contract and – in Austria – the collective agreements, which contain labor law provisions. Laws, company agreements and EU regulations also play a role.

Issues that lawyers for employment law repeatedly deal with are, for example, remuneration, working hours, dismissal and protection against dismissal and, in some sectors, occupational safety. All-in contracts are also a recurring component of employment law disputes.

This is regulated in the employment contract

Both employees and employers have rights and obligations in their mutual working relationship. These are set out in the employment contract. Examples of this are

  • Start of employment: start and, if applicable, end (in the case of fixed-term contracts) of the employment relationship

  • Place of work: Where is the place of work? Can employees also have to work at other locations? To what extent is it possible to work from home and to what extent is there a right to do so?

  • Working hours: What are the employee’s working hours?

  • Work performance: What are the activities attributed to the employee?

  • Remuneration: Amount and due date of the basic salary and any other special payments

  • Vacation: How much vacation is an employee entitled to?

  • Notice periods: What notice periods must be observed when giving notice?

  • Expiry: When can claims by employers or employees no longer be asserted?

  • Non-compete/non-competition clause: Is the employee permitted to work for other companies at the same time? Does he have to wait after the employment contract expires before he is allowed to reapply?

  • Contractual penalty: When is the employee liable for damages?

  • Overtime flat rates: Which salary is attributable to normal working hours and which to overtime?

We recommend always putting the employment contract in writing, even if it can also be concluded verbally. This reduces the risk of misunderstandings.
